KPC Healing LLC: Client Waiver, Release of Liability, and Informed Consent

KPC Healing LLC ("KPC Healing," "we," "us") is a Utah limited liability company at 3516 S 800 W, Bountiful, UT 84010. Sessions booked through kpchealing.com are delivered by KPC Healing or by an independent practitioner booked through the site (each a "Provider"). This form covers both KPC Healing and the Provider who performs your session. Please read it carefully before your session. We're glad you're here, and we want you to feel informed and safe.

1. What these services are

Our services include sound baths, sound healing, energy healing, one-on-one emotional release and energy healing sessions, and guest facilitation at wellness retreats. These are complementary wellness practices meant to support relaxation and well-being.

They are not medical care, psychological care or psychotherapy, or massage therapy. Providers do not diagnose, treat, cure, or prevent any illness or condition, and do not prescribe or recommend changes to medications. These services are not a substitute for care from a licensed physician, mental health professional, or other licensed provider.

KPC Healing's owner is certified in Sound Healing and Energy Healing through the Utah Energy Healing Center. These certifications are not medical or state professional licenses.

2. Your ongoing care

I agree to keep seeing my doctor and other licensed providers as I normally would, and to keep taking any medications as prescribed. I will not stop or delay medical or mental health care because of these sessions.

3. Health cautions for sound and energy work

Sound vibration and deep relaxation are gentle for most people, but please tell your Provider before the session if any of the following apply. You may want to consult your doctor first.

• Pregnancy
• Epilepsy or a history of seizures
• A pacemaker, cochlear implant, or other implanted medical device
• Sound sensitivity, tinnitus, or hearing conditions
• A severe mental health condition, including PTSD, psychosis, or a recent crisis
• Any other condition that could be affected by sound, vibration, lying still, or strong emotion

I agree to share relevant health information honestly and to update my Provider if anything changes. I understand that my Provider may adjust or decline a session if they believe it is not a good fit for me.

4. Touch and consent

Some sessions may include light touch. Any touch is light, I remain fully clothed, and touch happens only with my consent. I may decline touch at any time, before or during the session, and I may ask to pause or stop the session at any time without needing to explain why.

5. Emotional release

Emotional release and energy work may bring up strong feelings, memories, or physical sensations such as tears, tiredness, or restlessness. These experiences are usually temporary. I understand that my Provider is not acting as a therapist, and I will seek support from a licensed mental health professional if I need it. I understand that KPC Healing services are not emergency or crisis services. If I am having an emergency or a crisis, or I am in immediate danger, I will call 911 or go to the nearest emergency room right away.

6. Assumption of risk

I understand that these services carry some risks, including physical discomfort, dizziness on getting up, emotional distress, and reactions to sound or vibration. I choose to take part voluntarily and accept these risks.

7. Release and indemnity

To the fullest extent Utah law allows, I release, waive, and agree not to sue KPC Healing LLC, its owner, members, employees, and agents, and the Provider who performs my session (together, the "Released Parties") for any claim, injury, loss, or damage arising from my participation, including claims based on the ordinary negligence of a Released Party. I also agree to indemnify and hold harmless the Released Parties from claims arising from my own actions, my failure to share relevant health information, or my breach of this form. This release does not cover gross negligence, willful misconduct, or anything else Utah law does not allow to be waived.

8. Confidentiality

What I share in a session is kept confidential by KPC Healing and my Provider, except where disclosure is required by law, needed to protect someone's health or safety, or where I give permission. Details on how my information is handled are in the KPC Healing Privacy Policy at kpchealing.com.

9. Minors

Clients under 18 need a parent or legal guardian to sign this form. The guardian confirms that they consent to the minor's participation, agree to the terms above on the minor's behalf to the extent the law allows, and will share the minor's relevant health information. The parent or guardian must be present for the whole session.

10. General terms

This form is governed by the laws of the State of Utah. If any part is found unenforceable, the rest remains in effect. This form, together with the Terms of Service, is the full agreement about my participation, and it applies to this session and any future sessions with KPC Healing or a Provider booked through kpchealing.com unless I withdraw it in writing.

11. Session bundles

Session bundles are prepaid packages of sessions with a single provider. Any session in a bundle that has not been booked or used by the bundle's expiry date is automatically refunded to your original payment method at that session's allocated share of the bundle price. You may also request a refund of all unused sessions at any time before expiry. Sessions cancelled less than 24 hours (including exactly 24 hours) before the start time, and missed sessions (no-shows), count as used and are not refundable. Bundles are not gift cards or stored value, have no cash value, and cannot be transferred.
