KPC Healing LLC: Website Terms of Service

Welcome to kpchealing.com (the "Site"). These Terms of Service ("Terms") explain how you can use the Site, book sessions, and buy products through it. By using the Site, booking a session, or buying a product, you agree to these Terms. If you don't agree, please don't use the Site.

1. Who we are

The Site is operated by KPC Healing LLC ("KPC Healing," "we," "us"), a Utah limited liability company at 3516 S 800 W, Bountiful, UT 84010. KPC Healing runs a marketplace with two kinds of sellers: wellness practitioners who offer sessions, including KPC Healing's owner and independent practitioners ("Providers"), and independent sellers who offer products ("Product Sellers").

2. How the marketplace works

• Providers are independent. Providers other than KPC Healing's owner are independent businesses offering their own services through the KPC Healing marketplace. Providers are not employees, agents, or contractors of KPC Healing, and KPC does not direct or control how they deliver their services. Each Provider is solely responsible for the services they deliver, their qualifications, and their conduct.
• Provider insurance. Independent Providers may or may not carry their own insurance, and each is responsible for their own services. Sessions delivered by KPC Healing or its employees are covered under KPC Healing's own business insurance.
• What KPC Healing does. KPC Healing arranges bookings, hosts Provider profiles, and collects payment on the Provider's behalf through Stripe. Provider earnings are paid out to Providers through Stripe Connect.
• Provider information. Providers supply their own profiles, credentials, and descriptions. We ask Providers to confirm their certifications, but we do not guarantee any Provider's qualifications or results. Please ask your Provider any questions before booking.
• Product Sellers are independent. Product Sellers are independent sellers, not employees, partners, or agents of KPC Healing. Each Product Seller is solely responsible for their own products, listings, shipping, returns, and refunds.
• Your session agreement. When you book, you agree to receive services from the Provider you select, under these Terms and the Client Waiver and Informed Consent.

3. Bookings and payments

• Sessions are booked and paid online through the Site. Payments are processed by Stripe, Inc. under Stripe's own terms and privacy policy. KPC Healing does not see or store your full card number.
• Prices are shown at booking in U.S. dollars and may change at any time before you book. Applicable taxes, if any, are shown at checkout.
• Deposits: Some services require a deposit, which is shown on the service page and at booking. A deposit counts toward the price of your session and follows the cancellation rules below.
• You must complete and agree to the Client Waiver and Informed Consent before your first session.
• You must be at least 18 to book. A parent or legal guardian must book and sign for a minor and must be present for the whole session.

4. Cancellations, no-shows, refunds, and tips

• Cancelling more than 24 hours ahead: If you cancel more than 24 hours before your session starts, you receive a full refund of anything you paid, including any deposit.
• Cancelling within 24 hours: If you cancel within 24 hours of the start time, no refund is given. Any deposit or payment already made is kept as a cancellation fee.
• Rescheduling: To reschedule, cancel and book a new time. The 24-hour rule above applies to the cancelled session.
• No-shows: If you miss your session without cancelling, your Provider may mark it as a no-show, but only after the session's scheduled end time. You are then charged a no-show fee of 50% of the service price, and anything you paid beyond that amount is refunded. Arriving late may shorten your session.
• If a Provider or KPC Healing cancels or declines: You are not charged, and anything you paid is refunded in full. You are welcome to book another time.
• Event tickets: Cancel more than 24 hours before the event start for a full refund. Within 24 hours there's no refund, but you may transfer your ticket to someone else by contacting the host. If the host or KPC cancels or reschedules the event, you'll get a full refund, or you can keep your spot for the new date.
• How refunds are paid: Refunds go back to your original payment method through Stripe and may take several business days to appear.
• Session bundles: Session bundles are prepaid packages of sessions with a single provider. Any session in a bundle that has not been booked or used by the bundle's expiry date is automatically refunded to your original payment method at that session's allocated share of the bundle price. You may also request a refund of all unused sessions at any time before expiry. Sessions cancelled less than 24 hours (including exactly 24 hours) before the start time, and missed sessions (no-shows), count as used and are not refundable. Bundles are not gift cards or stored value, have no cash value, and cannot be transferred.
• Tips: Tips are optional and never expected. You can send a tip only after your session has ended, and not for a session that was cancelled or marked as a no-show. Tips can be from $1 to $1,000, are charged right away through Stripe, and go to your Provider (less the platform and card-processing fees described in the Provider's agreement with KPC Healing). Tips are non-refundable.

5. Product purchases

• Products are sold by Product Sellers, who are responsible for their products, including accuracy, safety, shipping, and fulfillment.
• Each physical product purchase follows that Product Seller's own return and refund policy, shown on the listing. Digital resources follow Section 6 instead. The 24-hour cancellation, no-show, and tip rules above apply only to sessions, not to products.
• Payments for products are processed through Stripe, the same way as session payments.
• Products are not medical care and are not meant to diagnose, treat, cure, or prevent any condition.
• Please contact the Product Seller first about any problem with an order. If you can't resolve it, email us and we will try to help.

6. Digital resources

When this Section applies. This Section, and the related digital resource terms in the Product Seller Terms (Sections 7 and 8) and the Provider Marketplace Terms (the Digital resources paragraph in Section 10 and the digital resources wording in Section 11), took effect on October 25, 2026 for accounts created on or after that date. For accounts created before October 25, 2026, they apply when you first upload, download, or otherwise use a Digital Resource, or on November 8, 2026, whichever comes first. Until then, the terms that applied to you before October 25, 2026 continue to apply. These changes do not affect any booking, product order, or payout made before October 25, 2026.

Providers and Product Sellers (together, "Sellers") may offer digital resources through the Site, such as worksheets, guides, audio, video, and courses ("Digital Resources"). Some are free. Others are paid, and the price is shown on the listing. KPC Healing reviews each Digital Resource before it is listed, but the Seller who made it is responsible for its content. Digital Resources are wellness and educational materials. They are not medical or psychological care and are not meant to diagnose, treat, cure, or prevent any condition.

• Who owns it. The Seller, or the Seller's licensors, own each Digital Resource. You buy a license to use it, not ownership. The license comes from the Seller. KPC Healing is not the licensor of Seller content. KPC Healing provides the store, checkout, and delivery.
• Your license. When you get a Digital Resource, free or paid, the Seller gives you a limited, non-exclusive, non-transferable license to download it and use it for your own personal use. If the listing says "professional use," you may also use it with your own clients in your own practice, for example by sharing printed or digital copies of a worksheet with a client during your work together. Professional use does not allow anything in the list below.
• What you may not do. Unless the Seller gives you written permission, you may not:
  • Resell, sublicense, rent, or give away the Digital Resource, or include it in a product of your own
  • Share your download links, files, or account access with anyone else
  • Post or upload the Digital Resource anywhere else, including websites, social media, shared drives, or course platforms
  • Remove or change any copyright notice, credit, watermark, or name in it
  • Use it, in whole or in part, to train, fine-tune, or build a dataset for any artificial intelligence or machine learning system
  • Claim it as your own work
• Downloads and access. You must be signed in to download. Download links expire shortly after they are created (currently 5 minutes), and daily download limits apply (currently 20 downloads a day). Please save a copy of your file when you download it. The Seller may stop selling a resource, and KPC may remove one under our Product Seller Terms, so we can't promise it will stay available on the Site forever.
• Versions. If a Seller updates a Digital Resource, you keep access to the version you paid for. A newer version may or may not be offered to you.
• Refunds. Digital Resources can't be returned. All sales are final once you have downloaded or opened the resource, except as follows:
  • Not yet downloaded: If you have not downloaded or opened it, you may ask for a full refund within 14 days of purchase.
  • Defective or not as described: If the file is corrupt, won't open, is missing content, or is materially different from its listing, tell us within 14 days of purchase. We or the Seller will try to fix it or send a working copy. If that can't be done within a reasonable time, you get a full refund.
  • Duplicate purchase: If you accidentally bought the same resource twice, we refund the extra purchase.
  • Unauthorized charge: If someone used your payment method without permission, we refund the charge.
  • How to ask: Email kpchealing815@gmail.com with your order details. Approved refunds go back to your original payment method through Stripe and may take several business days to appear.
• When a license ends. Your license for a Digital Resource ends if the purchase is refunded or charged back, or if you break this Section. When it ends, your access is removed, and you must stop using and delete your copies. If we remove a resource because of a legal claim, such as a copyright complaint, we may also end access for buyers and decide fairly whether a refund is owed.
• Your rights under law. Nothing in this Section takes away any consumer right that the law gives you and that can't be waived.
• Reporting a problem. If you believe a Digital Resource or other content on the Site infringes your copyright or other rights, or uses your image or private information without permission, email kpchealing815@gmail.com with the details listed in our Product Seller Terms, Section 8.

7. Wellness disclaimer

Services offered through the Site, including sound baths, sound healing, energy healing, and emotional release sessions, are complementary wellness practices. They are not medical, psychological, or massage therapy care, and they do not diagnose, treat, cure, or prevent any condition. They are not a substitute for a licensed healthcare provider. Please keep seeing your doctor and take any medications as prescribed. Results vary, and no specific outcome is promised.

8. Retreat events

KPC Healing or its Providers may offer guest facilitation at wellness retreats organized by third parties. When a retreat is run by another organizer, that organizer is responsible for the venue, lodging, food, travel, and its own policies, and you may need to sign that organizer's waiver as well. KPC Healing is responsible only for the facilitation it agrees to deliver.

9. Intellectual property

The Site and its content, including the KPC Healing name and logo, text, images, audio, and design, belong to KPC Healing or its licensors and are protected by law. You may view the Site and share links for personal, non-commercial use. You may not copy, sell, or reuse Site content without our written permission. Providers keep ownership of the content in their own profiles. Digital Resources you buy or download are licensed to you under Section 6.

10. Acceptable use

Please use the Site respectfully. You agree not to:

• Give false information or book in someone else's name without permission
• Harass, threaten, or behave inappropriately toward a Provider or other client
• Arrange to pay a Provider outside the Site for sessions first booked through the Site
• Interfere with the Site's security or operation, or scrape, copy, or misuse its data
• Use the Site for anything unlawful

We may cancel bookings or block access for anyone who breaks these rules.

11. Limitation of liability

To the fullest extent Utah law allows:

• The Site and services are provided "as is," without warranties of any kind beyond those stated here.
• KPC Healing is not responsible for the acts, omissions, services, or products of independent Providers or Product Sellers.
• KPC Healing is not liable for indirect, incidental, special, or consequential damages.
• KPC Healing's total liability for any claim related to the Site or a booking is limited to the amount you paid for the booking that gave rise to the claim.

Nothing in these Terms limits liability that cannot be limited under Utah law.

12. Indemnity

You agree to indemnify and hold harmless KPC Healing, its owner, members, and agents from claims, losses, and costs (including reasonable attorney fees) arising from your breach of these Terms, your misuse of the Site, or your violation of the law or someone else's rights.

13. Dispute resolution

We'd like to resolve any concern directly first, so please email us at kpchealing815@gmail.com and give us 30 days to work it out with you. If we can't, these Terms are governed by Utah law, and either of us may bring the dispute in small claims court, where eligible, or in the state or federal courts located in Davis County, Utah. You and KPC Healing agree to that venue.

14. Changes

We may update these terms. For material changes, we'll post the new version with its effective date and notify registered users by email or on the site at least 14 days before it takes effect, unless a change is required by law sooner. Continuing to use the Site after a change takes effect means you accept the updated Terms. Changes won't affect bookings you have already paid for unless the law requires it.

15. General

If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, the Client Waiver and Informed Consent, and the Privacy Policy are the full agreement between you and KPC Healing about the Site.

AI access plans and automatic renewal

After your 5 free requests to start, AI features in the Scripture and Wellness libraries are available on one of these plans:

• $2.99/month
• $29.99/year (About 2 months free)
• Lifetime: $49.99 one time, no renewals

Fair use. Each plan has a fair-use limit: Up to 300 AI requests every 30 days. When you reach the limit, AI features pause until your allowance resets.

Automatic renewal. Monthly and yearly plans renew automatically at the then-current price at the end of each month or year until you cancel. We charge the payment method you used at checkout.

How to cancel. Cancel anytime in Settings under AI access, or through the billing portal linked there. Cancellation takes effect at the end of the current paid period, and you keep access until then. Cancelling stops future charges.

Refunds. We don't refund partial periods, except where required by law.

Failed payments. If a renewal payment fails, your access continues to the end of the period you already paid for and then stops until payment succeeds.

Price changes. We will notify you in advance before a new price applies to your plan.

Lifetime. Lifetime is a single $49.99 payment. It does not renew and there is nothing to cancel. It includes the same fair-use limit as the plans, for as long as these AI features are offered on the site.

One-time activation holders. If you bought the earlier one-time AI activation, you keep your AI access without a subscription.
